Terms of Service
Acceptance of Terms
These Terms of Service (Terms) govern your access to and use of the Meds2Australia website and related services (collectively, the Services). By accessing or using the Services, you agree to be bound by these Terms and all applicable laws and regulations in Australia. If you do not agree, you must not use the Services.
Updates to These Terms
We may amend these Terms at any time to reflect changes to our Services, legal or regulatory requirements, or for security and operational reasons. Changes take effect when posted on this page with a revised “Last updated” date. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
Definitions
In these Terms: “Meds2Australia”, “we”, “us” or “our” refers to the owner and operator of the Services. “You” or “your” means the individual accessing or using the Services. “Australian Consumer Law” or “ACL” refers to Schedule 2 of the Competition and Consumer Act 2010 (Cth). “Content” means text, graphics, information, guides, price insights, reviews, and other materials made available through the Services.
About Meds2Australia
Meds2Australia helps Australians find affordable, legally sourced medicines and TGA-approved generics by providing price comparisons, brand-versus-generic information, and evidence-based alternatives for common conditions. We publish plain-English disease guides, side effects, and treatment options, and provide information on buying safely through licensed pharmacies and understanding prescription requirements.
We are not a pharmacy, healthcare provider, or telehealth service. We do not dispense medicines, issue prescriptions, provide medical, pharmaceutical, or therapeutic advice, diagnose conditions, or provide emergency assistance. We are not affiliated with the Therapeutic Goods Administration (TGA), the Pharmaceutical Benefits Scheme (PBS), or any government agency.
Eligibility and Australian Use
The Services are designed for persons located in Australia and may reference Australian laws, guidelines, and pricing. You must be at least 18 years of age to use the Services. You are responsible for ensuring the Services are lawful where you access them. We may restrict access from jurisdictions where use would be unlawful.
No Medical Advice; Emergencies
The Content is for general information and educational purposes only. It is not medical, pharmaceutical, or health advice and must not be relied upon as a substitute for professional advice, diagnosis, or treatment. Always seek the advice of your doctor, pharmacist, or other qualified health professional with any questions you have regarding a medical condition, medication, or treatment, and do not disregard professional advice because of something you read on the Services.
If you are experiencing a medical emergency, call 000 or your local emergency number immediately.
Regulatory and Prescription Compliance
Medicines in Australia are regulated under the Therapeutic Goods Act 1989 (Cth) and associated regulations. Prescription medicines may only be supplied in Australia by or under the supervision of a registered pharmacist upon presentation of a valid prescription from an Australian-registered prescriber, unless an applicable legal exemption applies. You are solely responsible for complying with all applicable laws regarding the possession, importation, use, prescribing, and supply of medicines.
We make no representation that any product, service, or supplier mentioned is lawful, available, or appropriate in your location. We encourage you to verify prescription requirements, scheduling status, and approvals before purchase. We are not responsible for any breach of law by you or any third party.
Pricing, Savings and Availability Information
Any prices, savings estimates, availability data, or comparisons provided are for informational purposes only. They may be based on publicly available data, user submissions, partner disclosures, or periodic surveys, and may change without notice. Actual prices, fees (including shipping), taxes (including GST), rebates, eligibility for subsidised pricing, and stock status are determined by the applicable pharmacy or supplier at the time of purchase. We do not guarantee that any price, deal, or availability will be honoured.
Unless stated otherwise, monetary amounts are expressed in Australian dollars (AUD) and inclusive of GST where applicable.
Third-Party Pharmacies, Services and Links
The Services may reference or display information about third-party pharmacies, telehealth providers, wholesalers, or other services (Third Parties). We do not own, control, endorse, or assume responsibility for any Third Party, their products, services, practices, or websites. Your interactions with Third Parties are solely between you and them, and may be subject to their terms and privacy policies. We are not responsible for loss or damage arising from your dealings with Third Parties.
We may receive referral, sponsorship, or advertising fees in connection with certain listings or placements. Such relationships do not influence our commitment to present information honestly and in good faith; however, you should independently verify all claims and pricing.

You may be required to create an account to access certain features. You must provide accurate and complete information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. Notify us immediately if you suspect unauthorised use. We may refuse, suspend, or terminate accounts at our discretion where permitted by law.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial use. Except as permitted by law or these Terms, you must not reproduce, distribute, create derivative works of, publicly display, or exploit any part of the Services without our prior written consent.
User Content and Reviews
If you submit content (including reviews, comments, ratings, suggestions, or feedback), you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display that content in connection with the Services and our business. You represent and warrant that you own or have all necessary rights to submit such content and that it does not infringe any rights or laws.
We may moderate, edit, refuse, or remove content at our discretion where permitted by law, but we do not undertake to screen all content. User views do not necessarily reflect our views.
Consumer Guarantees and Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement. To the extent permitted by law, and in respect of any non-excludable guarantees, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
Disclaimers
To the maximum extent permitted by law, the Services and Content are provided on an “as is” and “as available” basis. We make no representation or warranty of any kind, express or implied, including as to accuracy, completeness, reliability, currency, merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, secure, or error-free.
Information about medicines, generics, approvals, indications, contraindications, side effects, interactions, and availability may change without notice and may be incomplete or out of date. You must verify information with a qualified health professional and the dispensing pharmacy.
Limitation of Liability
To the maximum extent permitted by law and subject to the Australian Consumer Law, we exclude all liability for indirect, special, incidental, consequential, exemplary, or punitive damages, loss of profits, loss of data, or loss of opportunity arising out of or in connection with the Services or these Terms, even if advised of the possibility of such loss.
To the extent liability cannot be excluded, our total aggregate liability to you for all claims arising out of or in connection with the Services or these Terms is limited to the greater of AUD $100 or the amount you paid us (if any) for access to the Services in the 12 months preceding the event giving rise to the claim.
Indemnity
You agree to indemnify and hold harmless Meds2Australia, its owner, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees on a solicitor and own client basis) arising out of or in any way connected with your breach of these Terms, your misuse of the Services, your violation of law, or your infringement of any third-party rights.
Privacy and Cookies
We handle personal information in accordance with our privacy practices and applicable Australian privacy laws. By using the Services, you consent to the collection, use, and disclosure of your information as described in our privacy practices. The Services may use cookies or similar technologies to operate, secure, and improve your experience. You can manage cookie settings in your browser; however, some features may not function properly if cookies are disabled.
Electronic Communications and Records
By using the Services or sending us emails, you consent to receive communications from us electronically and agree that such communications satisfy any legal requirement that communications be in writing.
Changes, Availability and Maintenance
We may modify or discontinue any part of the Services at any time without notice. We may perform maintenance that temporarily affects availability. We are not liable for any unavailability, modification, suspension, or discontinuance of the Services, except as required by law.
Suspension and Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have breached these Terms, violated law, or pose a risk to the security or integrity of the Services. Upon termination, your right to use the Services ceases immediately, but provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and indemnities) will survive.
Governing Law and Jurisdiction
These Terms are governed by the laws of the Commonwealth of Australia and the laws of the State of New South Wales. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
Complaints and Dispute Resolution
If you have a concern or dispute, please contact us first so we can attempt to resolve it promptly and in good faith. We aim to acknowledge complaints within 5 business days and to provide a response or proposed resolution within 30 days where reasonably possible. Nothing in this section limits your rights to seek assistance from consumer protection bodies or to commence proceedings.
Copyright Notices and Takedown Requests
We respect intellectual property rights. If you believe that material on the Services infringes your copyright under the Copyright Act 1968 (Cth), please send a notice specifying the allegedly infringing material, its location (URL or description), your contact details, and a statement that you are the rights holder or authorised to act for the rights holder. We may remove or disable access to material that is alleged to infringe and may terminate repeat infringers where appropriate.
Severability and Miscellaneous
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior understandings. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
